The Swiss Federation of Fitness Centers (FSCFS) has filed a liability claim against the Confederation. The closure ordered by Berne causes significant losses in turnover, which it considers “disproportionate”.
Cited by the Sunday view, the president of the federation, Claude Ammann, denounces “arbitrary forced closures”. With this complaint, filed with the Federal Department of Finance (FDF), the umbrella company wants to force the Confederation to pay damages for the financial losses suffered, she said in a statement on Sunday.
The FDF confirmed to Keystone-ATS that it has received complaints. There are less than ten, specify the services of Ueli Maurer, who can not make other comments because of the procedures in progress.
The FSCFS coordinates and finances a model complaint against the Confederation. In this complaint, drafted by Urs Saxer, professor of law at the University of Zurich, a Bernese fitness company seeks damages in the amount of 259,000 francs.
According to Urs Saxer, a liability action is the only way to assert claims for damages. The Federal Council exercised its discretion “in a manifestly non-objective and illegal manner”. He made a hasty, undifferentiated and incorrect assessment of the situation, adds the Zurich professor, interviewed by Keystone-ATS.
According to the FSCFS, fitness centers are increasingly threatened in their existence. The hardship aid has no measure with the losses suffered during months. There is also no evidence that people are more likely to be infected in a gym than in public transport or shops, the statement added.
